These terms and conditions govern all sales concluded on studiozik.com between Studio Zik and its customers, whether consumers or professionals. They are drafted in French and translated for information into English, Spanish, Italian and German; in the event of a discrepancy in interpretation, the French version prevails between the parties, without prejudice to the mandatory consumer protection provisions applicable in the customer's country of residence.
Article 1 — Identity of the seller
Studio Zik, [à compléter] incorporated under Italian law, whose registered office is at Via del Lavoro 18, 38068 Rovereto (TN), Italie, partita IVA / tax code 02418590226, REA TN-223049, owner of the website studiozik.com, which it operates under the trading name StudioZik. Shipping and returns are handled at that same address.

Article 2 — Subject matter and scope
These terms set out the rights and obligations of the parties in the context of the distance sale of used music and studio equipment. They apply without restriction or reservation to every order placed on the site, to the exclusion of all other terms, in particular those of a business customer.
Placing an order entails full and unreserved acceptance of these terms, which the customer acknowledges having read beforehand by means of the dedicated tick box at basket validation.
StudioZik delivers to European Union Member States, Switzerland, the United Kingdom, Norway, Iceland and Liechtenstein. Deliveries to other destinations are subject to a prior quotation.
Article 3 — Nature of the goods sold
All products offered are used goods that have already been in service. Each product page states:
- the model year assigned to the reference;
- a detailed condition (excellent, very good or good) together with a score out of ten;
- the net weight of the unit and its actual boxed weight, weighed with carton, bracing and accessories;
- the parcel dimensions and the number of parcels shipped;
- the exact contents of the delivered set;
- photographs of the actual unit offered for sale.
Cosmetic signs of use inherent in second-hand equipment (micro-scratches, rack marks, patina on potentiometers) do not constitute a lack of conformity where they are stated in the description or visible in the photographs and do not affect the functioning of the goods.
As stock consists of unique units, the available quantity is usually one. An item remains on sale until payment has actually been received: placing an order does not reserve it. Where competing orders cover the same unit, only the first whose payment clears is fulfilled; the others are cancelled and refunded in full.
Article 4 — Prices
Prices are stated in euros, inclusive of all taxes, excluding delivery charges which are invoiced in addition and displayed before final order validation.
Most used goods sold by StudioZik fall under the margin scheme for value added tax provided for by Articles 312 et seq. of Directive 2006/112/EC, transposed in Italy by Article 36 of Decree-Law No 41/1995. In that case the invoice bears the wording "Special scheme – Second-hand goods" and VAT is not recoverable by the buyer. Where an item falls under the standard scheme, VAT is shown separately on the invoice.
The reference market price shown struck through corresponds to the price observed at European specialist dealers and used marketplaces on the date the listing went live. It is presented for comparison and is not a manufacturer's recommended price. The reduction applied by StudioZik is between €200 and €300 depending on the product category.
StudioZik reserves the right to change its prices at any time; products are invoiced on the basis of the tariff in force when the order is validated.
For deliveries outside the European Union (Switzerland, United Kingdom, Norway), any customs duties, import taxes and clearance fees are borne exclusively by the recipient and are not included in the displayed price.
Article 5 — Ordering
The order process comprises the following steps:
- selecting the item(s) and adding to the basket;
- checking the order details, the shipped weight and the delivery charge;
- entering contact details and the delivery address;
- reading and expressly accepting these terms;
- validating the order, which entails an obligation to pay;
- display of the confirmation page showing the order reference and bank details;
- receipt of a confirmation email restating all of the above.
Before validation the customer may return to previous pages at any time to correct a data entry error or amend the basket. The sale is formed when the customer receives the confirmation email.
StudioZik reserves the right to refuse or cancel any abnormal order, in particular where an earlier dispute remains unresolved, where contact details are manifestly incorrect or where there is serious suspicion of fraud.
Article 6 — Secure payment
StudioZik offers two payment methods, at the customer's choice when the order is confirmed: card payment, secured by our payment service provider, and SEPA bank transfer. No other method is accepted: no cheques, no cash, no money orders, no cryptocurrency.
6.1 Card payment
Card payments are processed by Stripe Payments Europe, Ltd., authorised as an electronic money institution by the Central Bank of Ireland, with registered office at The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland, on behalf of Studio Zik, the holder of the payment account. The charge appears on the customer’s bank statement as STUDIOZIK.
Visa, Mastercard and American Express cards are accepted, as well as the Apple Pay and Google Pay wallets where the customer's device supports them.
Card details are entered on a page hosted by Stripe and protected by TLS encryption. Studio Zik never has access to the card number, its expiry date or its security code, and does not store them. Only the card brand and its last four digits are returned to us, solely for accounting reconciliation and for handling any refunds.
In accordance with Directive (EU) 2015/2366 ("PSD2") and the applicable regulatory technical standards, the transaction is subject to strong customer authentication (3-D Secure) operated by the issuing bank. A failed authentication causes the transaction to be declined, with no amount debited.
The charge is taken when payment is validated. The order is then confirmed immediately and goes into packing. Should an item prove unavailable after payment — which can occur where two orders cover the same one-off unit — the customer is refunded in full within fourteen days.
6.2 SEPA bank transfer
As a security measure, Studio Zik's bank details are published neither on the site, nor on the invoice, nor on any downloadable document. Once the order has been checked, they are sent to the customer by email, to the address given at checkout and to that address only, within one business day. The final invoice is sent separately by the orders team after that check.
The customer must state the order reference in the transfer description; failing that, bank reconciliation cannot be carried out and shipping is delayed.
The customer has five business days from receipt of that email to issue the transfer. During that period the item stays on sale and is not reserved: it goes to the first customer whose payment clears. A reminder is sent on the third day. If funds have not been received when the period expires, the order is cancelled as of right and the item returns to sale, with no compensation on either side.
6.3 Security warning
StudioZik never changes its bank details during an order and never communicates them by telephone, instant messaging or any message not originating from an @studiozik.com address. Any approach inviting you to transfer funds to another account must be treated as fraudulent and reported immediately to support@studiozik.com. If in doubt, check the IBAN on your order confirmation page, which is the only authoritative source.
Likewise, StudioZik will never ask a customer to disclose a card number by telephone, email or messaging: card details are only ever entered on Stripe's secure page.
6.4 Collection and transfer of ownership
For a card payment, the order is processed as soon as the transaction is accepted. For a transfer, it is processed once funds are actually received in Studio Zik's account, generally one to three business days after the transfer is issued depending on the customer's bank. An email confirms receipt of payment in both cases.
In accordance with Article L. 624-16 of the French Commercial Code, the goods remain the property of Studio Zik until the price is paid in full. The risk of loss and damage passes when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, in accordance with Article L. 216-4 of the Consumer Code.
6.5 Refunds
Any refund is made using the same payment method as the original order, unless the customer expressly agrees to another: a credit back to the card used, or a transfer to the account the payment came from. No charge is passed on to the customer in this respect.
Article 7 — Delivery only, no collection in person
StudioZik operates by shipping only. No collection in person, no handover by appointment and no public reception are possible: our premises are technical testing and packing workshops, not a retail outlet.

Shipping charges are calculated from the actual boxed weight stated on each product page; no surcharge is claimed after the order on account of weight or volume. Lead times are indicative and run from actual receipt of the transfer.
In accordance with Article L. 216-1 of the French Consumer Code, delivery takes place in any event within a maximum of thirty days from conclusion of the contract. In the event of failure, the customer may terminate the contract under Article L. 216-6 after an unsuccessful formal notice; sums paid are then refunded within fourteen days.
7.2 Packaging
Each unit is shipped in its original carton where this has been kept, failing which in a double-wall carton with high-density foam bracing on every face. Instruments with a neck are shipped with strings slackened and the neck braced. Speaker pairs are shipped as separate parcels. All shipments are insured to the invoiced value and tracked.
7.3 Receipt and reservations
It is for the customer to check the condition of the parcel in the carrier's presence. In the event of apparent damage, the customer must record precise and detailed reservations on the delivery note — the wording "subject to unpacking" has no legal value — and confirm those reservations to the carrier by registered letter within three working days, in accordance with Article L. 133-3 of the French Commercial Code, copying support@studiozik.com.
Customers are advised to photograph the packaging before opening and the contents during unpacking: this greatly assists any insurance claim.
Article 8 — Right of withdrawal
Under Articles L. 221-18 et seq. of the French Consumer Code, a consumer customer has fourteen calendar days to exercise the right of withdrawal without giving reasons and without bearing costs other than those set out below.
The period runs from the day on which the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods. Where an order is delivered in several parcels, the period runs from receipt of the last parcel.
8.1 How to exercise it
The customer notifies the decision by an unambiguous statement sent to support@studiozik.com or by post to the workshop (Via del Lavoro 18, 38068 Rovereto (TN), Italie). The model form reproduced in section 8.4 may be used but is not mandatory.
8.2 Returning the goods
The goods must be returned no later than fourteen days after notification of withdrawal, in their shipping packaging or packaging offering equivalent protection, together with all accessories supplied. Direct return costs are borne by the customer, in accordance with Article L. 221-23. Given the value of the equipment, the return must be made with tracking and insurance to the invoiced value.
The customer may be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning. The following are regarded as exceeding that scope: removing or altering serial number labels, opening the chassis, modifying components, installing unofficial firmware, or any new physical damage.
8.3 Refund
StudioZik refunds all sums paid, including the initial delivery charge at the standard delivery rate, no later than fourteen days from recovery of the goods or from the customer providing proof of dispatch, whichever occurs first. The refund is made by bank transfer to the account used for payment, at no cost to the customer.

Article 9 — Statutory guarantees
Independently of any commercial warranty, Studio Zik remains bound by the following statutory guarantees:
9.1 Statutory guarantee of conformity
Articles L. 217-3 to L. 217-20 of the French Consumer Code. The seller delivers goods that conform to the contract and is liable for lacks of conformity existing at delivery. For used goods, the period during which the defect is presumed to have existed at delivery is twelve months (Article L. 217-7). The customer may request repair or replacement and, failing that, a price reduction or rescission of the sale. During that period the customer does not have to prove that the defect existed at delivery.
9.2 Guarantee against hidden defects
Articles 1641 to 1649 of the French Civil Code. The customer may choose between rescission of the sale and a price reduction, within two years of discovering the defect.
9.3 StudioZik commercial warranty
StudioZik additionally grants a twelve-month contractual commercial warranty from delivery, covering operating faults. It is implemented by covering the return, repairing or, where repair is impossible, refunding. This warranty does not cover:
- consumables and normal wear parts (valves, batteries, belts, potentiometers, faders, jack sockets);
- damage resulting from a drop, liquid, overvoltage, non-compliant power supply or use inconsistent with the intended purpose;
- work carried out by an unapproved third party;
- cosmetic wear.
The commercial warranty is without effect on the statutory guarantees, which apply in any event.
9.4 Spare parts
As these are used goods, Studio Zik cannot guarantee the availability of spare parts from manufacturers. Where information on such availability is provided by the manufacturer, it is reported on the product page.
Article 10 — Business customers
Where the customer acts for purposes relating to their trade or profession, the right of withdrawal in Article 8 does not apply, save where the contract is concluded away from business premises, the subject matter of the contract does not fall within the professional's main field of activity and that professional employs fewer than six people (Article L. 221-3 of the French Consumer Code). The statutory conformity guarantees of the Consumer Code likewise do not apply; the guarantee against hidden defects and the twelve-month commercial warranty remain available.
Under Articles L. 441-10 and D. 441-5 of the French Commercial Code, late payment by a business customer automatically triggers penalties calculated at the European Central Bank's most recent refinancing rate plus ten percentage points, together with a fixed recovery indemnity of €40.
Article 11 — Complaints and customer service
Complaints must be sent to support@studiozik.com quoting the order reference. We acknowledge receipt within two business days and give a reasoned reply within fifteen business days at the latest.
Article 12 — Mediation and dispute resolution
Under Articles L. 611-1 et seq. of the French Consumer Code, a consumer may, free of charge and after a written complaint has gone unanswered satisfactorily for one month, refer the matter to a consumer ombudsman with a view to an amicable settlement. The contact details of the ombudsman appointed by Studio Zik are provided on request to support@studiozik.com and restated in any reply to a complaint.
Article 13 — Force majeure
Neither party may be held liable for a failure to perform resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code. Performance of obligations is suspended for the duration of the event; if it exceeds thirty days, either party may terminate the contract without compensation, sums paid then being refunded.
Article 14 — Personal data
The processing of personal data is described in our privacy policy, which forms an integral part of these terms.
Article 15 — Partial invalidity and non-waiver
If any provision of these terms is held void or unenforceable, the remaining provisions retain full force. Studio Zik's failure to rely on a breach shall not amount to a waiver of the right to rely on it subsequently.
Article 16 — Governing law and jurisdiction
These terms are governed by French law. In accordance with Article 6 of Regulation (EC) No 593/2008 ("Rome I"), that choice does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
Pursuant to Article 18 of Regulation (EU) No 1215/2012, a consumer may bring proceedings either before the courts of the Member State where the seller is domiciled or before the courts of the place where the consumer is domiciled. For disputes with a business customer, jurisdiction is conferred on the courts having jurisdiction over Studio Zik's registered office.
